Troy, Ohio PorchFest Food Vendor Agreement Form

Please complete this form, pay fee by December 31, 2024.
Please provide proof of appropriate secondary insurance and obtain your licensing including the City of Troy license by February 28, 2025.

Guidelines for Food Vendors

1.  I understand that the Troy-Hayner Cultural Center cannot be responsible for loss or damage to any exhibit, personal
     property, personal injury or accident suffered on the premises.
2.  I understand that in the event of bad weather the festival may be cancelled. Your fee will be refunded upon request.
3.  Load-in for vendors must occur before 10:00 am Saturday, September 13, 2025
     Load-out should occur after 7:00 or after the last set has finished.
4.  All Food vendors ARE REQUIRED to provide evidence of Commercial General Liability insurance in the amount of $1     million per occurrence with the Troy-Hayner Cultural Center as the certificate holder. CLICK HERE FOR CERTIFICATE OF INSURANCE INFORMATION
5. I understand that it is my responsibility to discover and comply with all federal, state, county and city regulations including The City of Troy background check for all food vendors. This background check is mandatory and is called, "Mobile Food Vehicle Vending License."  This costs $25.00 and requires several weeks turnaround time. INDEMNITY AGREEMENT: To the maximum extent permitted by applicable law, Representative (you, on behalf of your business, workers, volunteers and/or any subcontractors) agree to save harmless and defend the indemnified parties, the employees, the Board of Governors, the volunteers of  Troy-Hayner Cultural Center, The Friends of The Hayner,  The Troy City School System, The City of Troy, Ohio, from and against any and all claims, losses, damages, fines, causes of action suits and liability of every kind including court costs and attorneys’ fees for injury to or death of any person, for damage to any property, for loss of business, for consequential damages and all other damages (collectively, “damages”) arising out of or in connection with this event.

    The vendor named above, its officials, employees, and agents agree to indemnify and hold harmless the Troy-Hayner Cultural Center, its volunteers, its staff, its governing board,  the Friends of Hayner organization and its board, the Board of Education and the Troy City School System and the Troy Miami County Public Library and its staff, against all loss, expense, damage claims, injuries, cause of action, attorney fees, and court costs which may occur or be sustained by or arise from acts or omissions related to the Troy, Ohio PorchFest.
